O artigo enfoca o individualismo metodológico de Jon Elster e suas análises a respeito dos pré-compromissos constitucionais. O problema do trabalho diz respeito as possibilidade e limites da opção metodológica do autor para este debate no contexto dos regimes políticos democráticos. Para tanto, o texto analisa revisões feitas pelo próprio autor no decorrer da sua obra, como também objeções e críticas desenvolvidas a partir do referencial da Teoria Democrática contemporânea.

This is based on the assumption that such standards increase legitimacy among stakeholders. Yet, a wide variety of standards with different requirement levels exist and companies might tend to introduce the ones with low exigencies, using them as a legitimacy front. This strategy jeopardizes the reputation of social and environmental standards among stakeholders and their long-term trust in these instruments of CSR, meaning that (...) all expenses for their implementation are of no avail for the companies. Therefore, this paper highlights which criteria are important for the selection, implementation and improvement in order to achieve a company's aim, but also to strengthen the legitimacy of social and environmental standards. This research is based on conceptual thought and some existing empirical research, comparing four different social and environmental standards, revealing weaknesses and strengths. It exposes the basic conditions for the success of such standards among stakeholders and identifies the need for more empirical data. (shrink)

The term sustainability has become one of the most significant in the current era. It seems to be ubiquitous amongst academics, politicians, business leaders, media personnel and even the general public. It is no exaggeration to state that it is considered all over the world to be the most pressing issue to be addressed for the long-term future of the planet and its inhabitants. The topic is of course complex, and the issue of sustainability is under much debate as to (...) what it actually is and how it can be achieved, but it is completely certain that the resources of the planet are fixed in quantity and, once used, cannot be reused except through being reused in one form or another. At present, much of the discourse of sustainability has focused upon the environment and in particular upon climate change and the effects that this is having. Thus, the discourse has tended to be about mitigation. Sustainability of course requires all three pillars of the triple bottom line—economic, environmental and social—to be addressed. Indeed, it might be considered that the effects upon the social, and how we choose to live our lives, might well be the most profound effect of achieving sustainability. This book therefore focuses upon some of the many aspects of the social and how we can adapt our lives to accommodate the requirements of sustainability. it therefore takes a very different approach to addressing the issues of sustainability, while of course not ignoring the other pillars. This book therefore sets out to examine various aspects of the changes to personal, corporate and institutional behaviour which may have to come about in our search for sustainability. It is tended to address some of the issues and how they are being dealt with in various parts of the world. As always, our concept is to share best practice and thereby enrich both the discourse and our progress towards sustainability. Thus, we focus upon the current situation while also considering the extent to which the focus is changing so much that we need to think about new approaches to our understanding of behaviour and differing effects in practice. The international origins of the contributors to this book make this an original contribution taking some of the best ideas from around the world. This book therefore addresses these issues from a perspective not generally addressed by researchers, or even by politicians and the press. It therefore provides fresh perspectives upon the important issue of our common future. As always, this approach is based on the tradition of the Social Responsibility Research Network srrnet.org (a worldwide body of scholars with membership of several thousand), which in its 20-year history has sought to broaden the discourse and to treat all research as inter-related and relevant to business. This tradition has always been to explore the subject widely and to seek relevant solutions, while also sharing best practice. In this rejoinder, we respond to two commentaries on the study by Greiff, S.; Stadler, M.; Sonnleitner, P.; Wolff, C.; Martin, R. Sometimes less is more: Comparing the validity of complex problem solving measures. Intelligence 2015, 50, 100–113. The study was the first to address the important comparison between a classical measure of complex problem solving (CPS) and the more recent multiple complex systems (MCS) approach regarding their validity. In the study, we investigated the relations between one classical microworld as (...) the initially developed method (here, the Tailorshop) with three more recently developed multiple complex systems (MCS; here, MicroDYN, Genetics Lab, and MicroFIN) tests. We found that the MCS tests showed higher levels of convergent validity with each other than with the Tailorshop even after reasoning was controlled for, thus empirically distinguishing between the two approaches. The commentary by Kretzschmar and the commentary by Funke, Fischer, and Holt expressed several concerns with how our study was conducted, our data was analyzed, and our results were interpreted. Whereas we acknowledge and agree with some of the more general statements made in these commentaries, we respectfully disagree with others, or we consider them to be at least partially in contrast with the existing literature and the currently available empirical evidence. Small numbers are spontaneously associated with left space and larger numbers with right space (the SNARC effect), for example when classifying numbers by parity. This effect is often attributed to reading habits but a causal link has so far never been documented. We report that bilingual Russian-Hebrew readers show a SNARC effect after reading Cyrillic script (from left-to-right) that is significantly reduced after reading Hebrew script (from right-to-left). In contrast, they have similar SNARC effects after listening to texts in either (...) language. These results support the view that spatially directional scanning habits contribute to the spatial association of numbers but also emphasize its flexibility. (shrink)

Mental arithmetic is characterised by a tendency to overestimate addition and to underestimate subtraction results: the operational momentum effect. Here, motivated by contentious explanations of this effect, we developed and tested an arithmetic heuristics and biases model that predicts reverse OM due to cognitive anchoring effects. Participants produced bi-directional lines with lengths corresponding to the results of arithmetic problems. In two experiments, we found regular OM with zero problems but reverse OM with non-zero problems. In a third experiment, we tested (...) the prediction of our model. Our results suggest the presence of at least three competing biases in mental arithmetic: a more-or-less heuristic, a sign-space association and an anchoring bias. We conclude that mental arithmetic exhibits shortcuts for decision-making similar to traditional domains of reasoning and problem-solving. (shrink)

In a time marked by the development of innovative treatments in healthcare and the need for health professionals to deal with resulting ethical dilemmas in clinical practice, this study was developed to determine the influence of the bioethics teaching on the moral competence of medical and nursing students. The authors conduct a longitudinal study using the Moral Competence Test extended version before and after attending the ethics curricular unit, in three nursing schools and three medical schools of Portugal. In this (...) questionnaire the participant is confronted with three ethical dilemmas and asked to evaluate arguments for and against the attitude of the main character. For both nursing and medical students, C-score was lower after the attendance of the ethics curricular units, with a statistically significant decrease in the total score for nursing students and a decrease not statistically significant for medical students. A multivariate analysis did not find any association between this decrease and gender, course, or age. The phenomenon of moral segmentation was observed, with better performance in the worker and judge dilemma, than in the doctor dilemma. These results highlight the need to reflect on the curricular strategies that can be implemented for health professionals to better develop moral competence and decision-making, allowing for the provision of humanized health care. Statistics are key elements of contemporary life. They figure prominently in the media, in political discourse, and in daily conversations. They also weigh heavily within the economic and political spheres of modern societies. Yet, the study of statistics in the public sphere has been neglected by social scientists in favor of a focus on their production and history. This article remedies this lacuna by focusing on the public life of statistics. Through a case study of a financial indicator—country risk—that exhibited (...) a rich public life in Argentina in 2001, it argues that statistics are not simply transparent fragments of information, but rich symbols and collective representations able to condense multiple meanings and generate deep emotional reactions. Using in-depth interviews, newspaper covers, headlines, and leads, cartoons and archival materials, this article shows that country risk became a powerful collective representation and introduces a new concept, the fact-totem, to make visible the cultural life of statistics. A fact-totem is a statistic with high media presence that captures the imagination of diverse publics and becomes articulated with basic identity narratives of a collectivity. In August, Amnesty International and the World Medical Association expressed concern at reports that a judge in Saudi Arabia had asked several hospitals in the country whether they could perform an operation to damage a man's spinal cord as punishment for attacking another man and leaving him paralysed. The man had already been sentenced to seven months imprisonment for the crime, the injured victim requested the further sentence under Sharia Law, which is strictly enforced across Saudi Arabia. According to reports, (...) one of the hospitals approached declined on ethical grounds. Another hospital stated that it was possible to damage the spinal cord in the way requested, but that the procedure would have to be done at a specialised hospital. 1In its statement, Amnesty International urged the authorities not to carry out the sentence, which it argued would be a grave violation of international human rights law and contravene the United Nations convention against Torture, to which Saudi Arabia is a state party. 2 The WMA expressed its support for the physicians who refused to carry out the request by the Saudi court, participation in which would constitute a severe breach of medical ethics. 3 The WMA reminded doctors that the Declaration of Tokyo clearly states that no physician should participate in the practice of torture or any other forms of cruel, inhuman or degrading procedures, whatever the offence of which the victim of such procedures is suspected, accused or guilty of. The Declaration also includes a prohibition of participation in the planning or advising for such a procedure. Proponents of fetal rights argue that, from the moment of conception, a fetus has significant human rights. There are degrees of opinion, however, about the scope of those rights, with some arguing that, in certain circumstances, such as where the conception is the result of rape, the mother's rights predominate. Others argue that the fetus' rights are absolute and should override the woman's right to life and health so that pregnancies cannot be terminated, even to save women's lives. Various countries (...) explicitly or implicitly recognise the status of the fetus as a separate person with varying degrees of rights. For example, the Irish Constitution recognises the ‘right to life of the unborn’ and the 2004 US Unborn Victims of Violence Act views violence against a pregnant woman as a crime against two people, one of whom is the child in utero. The 1969 American Convention on Human Rights has been signed by most Latin American countries and recognises full human rights as applying from conception. In the UK, the fetus has no legal rights but it is widely agreed that the closer a fetus is to being capable of independent existence outside the womb, the greater the moral obligations owed to it. This is reflected in the abortion law only permitting termination of a pregnancy at the later stages in restricted circumstances.In Brazil, the issue of fetal rights was highlighted in May 2010 when a Bill was put forward which aimed to give the fetus priority in law and to make illegal any act or omission that could have a negative impact on it. In this article, I defend the idea that there are important differences between lying in politics and lying in general. My aim is to show that the issues with political lies do not have to do only with metaphysical or conceptual questions regarding what politics is or what the concept of the political means, or only with the validity of the excuses and justifications commonly offered in favor of political liars. I hold that the political lie is a special form (...) of lie due, first, to the peculiarity of the use of language in politics, and second, to the function that political lies play in political discussions: they undermine several epistemic conditions needed to impartially discuss social disagreements. In this work, however, I leave unanswered the question of what might be the best way to account for the epistemic conditions of democratic political discussion. (shrink)

Es corriente invocar el lenguaje de los derechos para demandar justicia. Sin embargo, el uso irreflexivo de este lenguaje puede ser perjudicial. En este trabajo, presento dos argumentos en favor de una más atenta reflexión sobre el concepto de derecho subjetivo. Primero, uso la distinción entre el concepto y la concepción de una noción normativa para precisar cuál es la clase de investigación que la reflexión sobre el concepto de derecho implica y los problemas que trae ignorarla para las prácticas (...) de reivindicación de justicia. Segundo, propongo que el que un individuo o colectivo tenga derecho a la satisfacción de un contenido dado significa que existen razones suficientes, pero no absolutas, para que alguien esté obligado a actuar de forma que contribuya razonablemente y de una manera especificada a la satisfacción de tal contenido. Esta propuesta del concepto de derecho subjetivo es “independiente”, en tanto permite la discusión de diferentes concepciones de derechos en una sociedad democrática. Además, articula la idea de que conceder un derecho implica siempre considerar la manera en que se distribuyen las cargas y responsabilidades al interior de una sociedad, así como la forma en que sus instituciones deben funcionar en conjunto. SPANISH: La suposición de la obediencia estricta, y las demás características de la sociedad bien ordenada (SBO), es una considerable idealización que hace Rawls de las circunstancias históricas reales en las que existen las sociedades contemporáneas. De allí la objeción de que todo el proyecto de la justicia como equidad es inútil, pues de nada sirve saber cuáles serían los principios de la justicia para una SBO que solamente existe en la teoría. Los objetivos de este artículo son aclarar el (...) significado de la suposición de una SBO del que se ocupa una teoría ideal, indicar las relaciones de este tipo de teoría con la metodología de la filosofía política y la noción de factibilidad y reevaluar la objeción de inutilidad a la luz de estas consideraciones. Se propone una respuesta doble a la objeción de inutilidad derivada de obra de Rawls. ENGLISH: The assumption of strict obedience, and other features of the well ordered society (WOS), is a great idealization that Rawls does from the actual and historical circumstances in which contemporary societies exist. From there comes the objection according to which the whole Project of justice as fairness is just useless, for it has no purpose at all to know what would it be the principles of justice for a well ordered society that only exist in theory. The aims of this paper are to make clear the meaning of the well ordered society’s assumption - the society which the ideal theory takes care of -; to point out the links between this kind of theory and the methodology of the political philosophy and the notion of feasibility; and to look again the useless objection in the light of the above considerations. Before the useless objection, it is proposed a twofold answer that could be inferred from Rawls work. (shrink)

Synthetic biologists design and engineer organisms for a better and more sustainable future. While the manifold prospects are encouraging, concerns about the uncertain risks of genome editing affect public opinion as well as local regulations. As a consequence, biosafety and associated concepts, such as the Safe-by-design framework and genetic safeguard technologies, have gained notoriety and occupy a central position in the conversation about genetically modified organisms. Yet, as regulatory interest and academic research in genetic safeguard technologies advance, the implementation in (...) industrial biotechnology, a sector that is already employing engineered microorganisms, lags behind. The main goal of this work is to explore the utilization of genetic safeguard technologies for designing biosafety in industrial biotechnology. Based on our results, we posit that biosafety is a case of a changing value, by means of further specification of how to realize biosafety. Our investigation is inspired by the Value Sensitive Design framework, to investigate scientific and technological choices in their appropriate social context. Our findings discuss stakeholder norms for biosafety, reasonings about genetic safeguards, and how these impact the practice of designing for biosafety. We show that tensions between stakeholders occur at the level of norms, and that prior stakeholder alignment is crucial for value specification to happen in practice. Finally, we elaborate in different reasonings about genetic safeguards for biosafety and conclude that, in absence of a common multi-stakeholder effort, the differences in informal biosafety norms and the disparity in biosafety thinking could end up leading to design requirements for compliance instead of for safety. Este ensaio teórico trata de uma elaboração conceitual sobre a condição de altas habilidades/superdotação, fundamentada nos pressupostos da teoria sociológica figuracional de Norbert Elias em associação à Psicanálise freudiana. As reflexões desenvolvidas neste ensaio sustentam a compreensão de altas habilidades como uma condição peculiar que se constitui em meio à emocionalidade vivida nas inter-relações humanas. De maneira mais evidente, a condição de altas habilidades é constituída em um processo de sublimação de emoções específicas que, vividas mais intensamente por algumas pessoas (...) em meio às tensões que narram a dinâmica das inter-relações que elas mesmas constituem, impulsionam um investimento libidinal em atividades valorizadas dentro de um processo histórico, cultural e social.
